The transfer of this present Agreement to another party can only be done with the permission of the person authorized by the Administration of the Railway, and certified to be the indorsement on this Agreement; otherwise the transfer shall be considered ineffective. The buildings on this land shall be given in lease to Russian subjects having the right to reside in Manchuria, and to Chinese subjects only.

10. In case the lessee should fail to comply with the conditions stated in paragraph 3 of this Agreement, this Agreement shall become void, and the leased land shall be taken away from the lessee, and shall pass into the possession of the Chinese Eastern Railway Company; and the rent paid under this Agreement shall not be returned, nor shall the lessee have the right to set up any pretension or claim for damages in the matter; and all the buildings on the land must be surrendered within a certain term appointed by the Administration.

11. After the expiration of the term of the lease, as stated in paragraph 2 of this Agreement, the lessee shall have the right to remove all buildings and other improvements that have been constructed on the land.

12. All notarial expenses on account of this lease, and also the stamp duty in case this Agreement is brought into a Russian Court, shall be paid by the lessee.

13. All misunderstandings that might arise between the parties to this Agreement regarding its execution shall be liable to litigation in accordance with the statutes of justice in the Pogranitchnaiya District Court.

14. This Agreement shall be kept sacred and inviolable. The original shall be kept by the lessee, and a copy by the Administration of the Railway Company.

Peking, October 26, 1908. THE Reform Decree of the 27th August, which was the subject of my despatches Nos. 390 and 408 of the 2nd and 14th ultimo, was followed on the 23rd instant by another Decree of the Empress-Dowager, commanding all public departments, besides those directly concerned in the preparation for Parliamentary Government, to furnish within six months a statement of the reforms which they propose to introduce within the next nine years, and also to present periodical reports on the work accomplished. I have the honour to inclose a translation of this Decree herewith.

Decree issued by the Empress Dowager on the 23rd October respecting Constitutional Reform in China,

(Translation.)

AN Imperial Decree has already been issued directing various departments of the Administration to carry out various measures in preparation for the inauguration of a Parliament in accordance with the Memorial submitted by the Constitutional Reform Commission and the Senate. These Imperial instructions were addressed to those departments most directly concerned in the establishment of a Parliament, but it is also the duty of other departments to introduce reforms which will assist in securing the success of the scheme. Thus the Wai-wu Pu should pay special attention to the conduct of international relations, the Board of Civil Office should improve the system of selecting officers for employment, the Board of Rites, the Board of Agriculture, and the other departments should introduce reforms in the various matters coming within their jurisdiction, and should do all in their power to further the attainment of constitutional reform. Even in the case of the Government offices directly referred to in the Memorial-the Boards of the Interior, of Finance, of Education, and of Law- there are many steps to be taken which have not been definitely specified. All the Public Departments are now directed to furnish within six months a statement of the reforms which they propose to introduce during the next nine years, and they must also furnish periodical reports on the measures taken by them, and these reports will be referred to the Constitutional Reform Commission and submitted to the Throne.
